Conditions of Sale

 

  1. Bidding is open to anyone who has registered. Bid by raising your bidder card if you will pay the price the auctioneer is calling. He points at you to acknowledge your bid. Do not raise your hand during bidding unless you are making a bid. When the last bid has been taken on an item, the auctioneer will announce the item is "sold," the "price" and successful "bidder number." If there is any dispute with the awarded bid, it must be made at this time. Once an item has been sold to your bidder number you are legally obligated to complete the purchase. Do not bid if you are not willing or able to fully pay for the item. We would be happy to arrange financing for you; however, you need to stop by the finance office before bidding to get your special yellow or green bidder card that will define your financing parameters. Do not bid based on financing arranged by King County Auction, unless you have a yellow or green bidder card.
  2. If you do not pay in full, immediately upon being awarded the winning bid, you may make a minimum 25% non-refundable deposit instead. If a deposit is not made by the end of sale day, legal action will be taken to recover 25% of the bid price. The following are acceptable forms of payment to King County Auction: cash, cashier's checks, money orders, traveler's checks, Visa, Mastercard or American Express. Winning bidders using credit cards for payment will be charged a 2% credit transaction fee on all amounts over $1000. (Sorry, King County Auction will not take company or personal checks). If you make a 25% deposit on sale day, the balance is due, in full, by 5:00 p.m. the following Tuesday, unless other arrangements have been made for you by King County Auction management. In the event that the following Monday or Tuesday is a holiday, and the banks are closed, the balance will be due on Wednesday by 5:00 p.m.
  3. All sales are final.
  4. In addition to the selling price of an item, the winning bidder shall be responsible for the following: (A) 10% buyer premium (min. $250) on the selling price of the vehicle (B) $50.00 documentary service fee (C) sales tax (dealers exempt) (D) estimated DOL and license fees. E. Winning bidders using credit cards for payment will be charged a 2% credit transaction fee on all amounts over $1000.
  5. King County Auction assumes no responsibility for any liability once a bid is accepted. Motor vehicles are sold by the seller and purchased by the purchaser "as is, where is and with all faults" and without warranties of any kind, either express or implied. Any warranties on vehicles sold hereby are those made by manufacturers. Purchasers will bear the entire expense of repairing or correcting any defects that presently exist or that may occur on or in this vehicle. King County Auction hereby disclaims any express or implied warranties under the Uniform Commercial Code, and particularly to comply with RCW 62A.2-316 and the Magnuson-Moss Warranty Act. (Exception is the special, limited 48 hour limited warranty per the Rules and Tips attachment.) However, the implied warranty of merchantability shall not be deemed disclaimed if the purchaser purchases from the seller a service contract as defined in RCW 48.96.010. The owner of a vehicle may be required to spend up to $150 for repairs if the vehicle does not meet the vehicle emission standards. Unless expressly warranted, King County Auction is not warranting that any vehicles will pass any emission tests required by federal or state law.
  6. While quantities and descriptions are believed to be correct, the Auctioneers or Sellers make no guarantee as to the accuracy of the description, authenticity, or defect of any lot or item offered for sale. Announcements made by the Auctioneer shall take precedence over any and all printed material.
  7. Exact mileage of vehicles sold at auction is unknown to King County Auction. Any disclosures of mileage statements made by King County Auction are based upon odometer readings which may or may not be accurate. Any person bidding on vehicle(s) at auction does so at their own risk with regards to actual vehicle mileage.
  8. The Auctioneers may, without giving any reason, refuse to accept the bidding of any person.
  9. The Auctioneers may, at their discretion and without any liability, cancel without notice the auction sale, either totally or in respect to any particular lot or lots, or to alter, vary, or withdraw any lot or lots, either before or at any time after the commencement of the sale and prior to the acceptance of the bid.
  10. King County Auction shall in no event be liable for the removal of any item sold. Removal shall be at the expense and risk of the buyer. Any item not removed within the specified time shall be forfeited to King County Auction. In addition to all other remedies allowed by law, King County Auction may retain all monies received as payment or otherwise, as liquidated damages.
  11. King County Auction acts only as an agent and is not responsible for acts of principals.
  12. The successful high bidder is responsible for the lot he purchased from the time the Auctioneer calls it sold. Neither the Seller nor the Auctioneers assume any responsibility for any loss, damage or theft occurring after the hammer falls.
